The following general terms and conditions of EMPRENDMENTOS HOSTELEROS VALENCIA (hereinafter, “EHV” or “The Owner”), are applicable to your order or reservation in the version in force at the time of contracting the service.

The terms and conditions apply exclusively to contracts made through the Internet portal and will comply with the provisions of current legislation and, in particular, Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

3. Object
These general contracting conditions (hereinafter, the “Conditions”) regulate the contracting of the services that are offered through the EHV Website, as well as the rights and obligations of the parties, derived from the provision operations. of services agreed between them, more specifically, the reservation of rooms, as well as reception and restaurant services.

 

4. Registration on the Web by Users / Clients.

Registration on the Website must be carried out by people of legal age. By creating a Client or User account, or by contracting any service, the User agrees to be responsible for the data they send and the services they offer, which will not be offensive or contradict applicable legislation.

Said data must be kept updated, and the User must guarantee the security of their Client/User account and their access credentials, being solely responsible for the activities carried out through their account.

Of course, the User will not use or impersonate another person’s account, nor provide false information through his or her account to mislead. Any of these behaviors will enable the Owner to cancel their account, without prejudice to being able to take any legal action they deem appropriate.

Any unauthorized use of your account must be immediately notified to EHV by the User.

 

5. Contracting the service
Contracting a service through the EHV Website implies acceptance by the Client/User of all the conditions stipulated in this document.

When the Client / User contracts a service or makes a reservation, and closes an agreement with EHV, the price and conditions will be indicated in advance before making any payment.

To obtain any clarification, make a claim or if any incident arises related to the service, the Client/User can contact the Owner at the email address reserva@hotelmalcomandbarret.com.

6. Hiring process

6.1. Bookings.
EHV offers you both the reservation of hotel rooms and the reservation of tables in restaurants.
Once the reservation is made, the client will receive a confirmation with the details of the reservation, prices, cancellation conditions and other relevant information, at the email address provided when making the reservation.

Regarding check-in and check-out times, they will be specified at the time of booking and may vary depending on availability. Additional charges may apply for unscheduled late departures.

Once you have made your online reservation on the EHV website, you will receive a reservation confirmation, with all the details of the reservation, the contract, the rates, the cancellation policy and any other relevant information.
To contract the services offered by EHV, the fields must be completed with the required data and accept these Terms and Conditions. This acceptance will mean express, full and unreserved agreement with all of the general conditions set out in the version published by EHV and which will be binding on both parties.

EHV will ensure that all services offered have legal coverage, quality guarantees and, where appropriate, the corresponding insurance.

To make payments for the services, EHV may use third-party providers such as payment gateways and other transaction processors. Each one has its own conditions and policies. All transactions will be carried out through secure payment platforms and with full guarantee of confidentiality of your data.

7. Prices
The price of the products/services is that indicated at all times on the Website.

8. Pricing error
If it is detected that there has been an error in the introduction of the price after the purchase by the Client, EHV must bring this matter to the attention of the Client as soon as possible to inform him of the incident, and offer him the option of cancellation or maintenance in the correct conditions.

Automatic confirmation submission does not validate erroneous pricing conditions. In case of cancellation, any amount that had been paid by the Client will be refunded.

The final price will be the one in force in the advertising coinciding with the moment of formalizing the reservation, without prejudice to any updates that may take place.

The Owner makes every effort within its means to offer truthful information without typographical errors on its Website.

9. Other expenses
If there are additional costs for the service, they will be communicated to the Client and broken down into the final price prior to payment for contracting the service.

10. Right of withdrawal
By virtue of article 103. l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the right of withdrawal will not be applicable to contracts relating to the supply of accommodation services for purposes other than housing, food or services related to leisure activities, if the contracts provide for a specific date or period of performance; Therefore, if the User unilaterally terminates the contract, they will not have the right to a refund of the amount paid for the reservation, without prejudice to the fact that EHV may voluntarily offer free cancellation or the option to modify their reservation for other dates.

Where applicable, the amount and method of refund of payments during the term of the contract, in the event of termination or non-compliance with it, will be paid as agreed by the parties, without said refund necessarily having to be made through the Web.

 

11. Duration of the contract
The validity of the contract will be subject to the duration agreement established by the parties, although in general it will extend to the period of time elapsed between the reservation of the room or service and the end of your stay in the place where you have reserved.
12. Obligations of Users
All EHV Clients or Users must make correct use of our Website, as well as our facilities, being solely responsible for any possible damages that may be caused to EHV or third parties due to their lack of diligence or malicious actions. Parents will be equally responsible for supervising their children at all times, exonerating EHV from any liability for accidents or damages caused by unsupervised children.

Through these conditions, the Client/User is responsible for the veracity and accuracy of the data and information provided to us as a result of the online services contract.

EHV reserves the right to restrict or deny the provision of a service to the Client / User if it becomes aware that said Client / User has failed to comply with the contract conditions, the general conditions of use of the Website, the privacy policy. , as well as any other particular conditions that could be agreed upon.

13. Disclaimer
EHV will not be responsible for misuse carried out by Clients / Users registered on the Website. In this sense, any damage caused to third parties of any kind, loss, theft or damage to guests’ property, whether in the rooms, restaurants, common areas or parking lots, will not be the responsibility of EHV. Clients are equally responsible for their personal effects.

EHV will not respond in situations beyond its control, such as strikes, natural disasters or technical breakdowns, which may cause disruption or cancellation of reservations.

EHV is not responsible for any illegal activities that may be carried out through the Website, and Clients must respect the establishment’s rules, including the rules of conduct. Any inappropriate, violent, disruptive or illegal behavior may result in expulsion from the establishment without refund.

 

14. Industrial and intellectual property
The products or services that we provide for reservation through our Website are subject to copyright. In addition, those logos, brands, texts, icons and other content subject to industrial and intellectual property rights are protected by the laws in force and applicable to the matter. The Owner has obtained authorization from the person holding said rights to use these contents or materials.

15. Conflict resolution
For those conflicts that may arise between the Client/User and EHV as a result of a breach of the contracting conditions, they will be governed by the provisions of current legislation, with the rules of the Spanish Legal System being applicable.

If any of these terms is considered void or unenforceable, such provision will be deemed unenforceable and will not affect the validity of the remaining provisions.

We inform you that there is a European platform for extrajudicial online resolution of disputes relating to contractual obligations arising from sales contracts or contracts for the provision of services concluded online between a consumer and a trader residing in the European Union, through the intervention of an entity alternative resolution.
